MSK MARKETERS DRAFT BILL – CALL FOR PUBLIC PARTICIPATION

SUBMISSION OF VIEWS ON MARKETERS DRAFT BILL

This Bill seeks to be enacted into an Act of Parliament to provide for the establishment of the Marketing Society of Kenya as a regulatory body and the Marketing Society of Kenya Examinations Board. It provides for their objects and functions, the examination, registration, regulation of standards of practice and for connected purposes. The raison de etre for this Bill is that it provides for the regulation of professional marketing practice in Kenya through the creation of statutory agency (MSK) with relevant bodies. This regulatory body instills ethics, professionalism, integrity and accountability of Society, its officials and members.

The Bill establishes standardization of learning, learning content, quality assurance, and continuous professional development by the creation of an examinations body known as the Marketing of Kenya Examinations Board. The Bill also seeks to promote robust professional practice through continuous learning. The Bill also defines criteria for registration with and certification by the professional regulatory body. It provides guidance to members in the form of codes of ethics, rules of professional conduct and standards of practice. The membership committee that it installs will ensure and maintain a public register which contains information about individuals registered with the professional body. It also establishes the disciplinary committee that investigates complaints about members and discipline members as required. It also provides for the rules of issuing and applying for practicing certificates. The draft Bill may be accessed and downloaded from the MSK website (www.msk.co.ke)

MSK is currently inviting members of the public and stakeholders to submit representations they may have on The Marketers Draft Bill. The representations may be forwarded to the CEO, MSK, P. O. Box 69826 Nairobi, hand delivered to the office of the CEO, MSK at 51 Lenana Road, Block B, Unit 5 or emailed to ceo@msk.co.ke to be received by 30th March 2022.
